CC, the kids, and I have all just moved in together. We don?t know if we?re going to get along, or how we?re going to fit in this small rental, or who is going to watch the kids when we go to work at night.

CC, being the friendly person that he is, sees a new neighbor outside and starts talking to him.

Turns out this neighbor is a Christian missionary to Zimbabwe, who, along with his wife and four daughters has just returned to spend a year in New Jersey . Not only do they live next door to us, but the eldest daughter is looking for child care work while she is applying for teaching positions.

I swear, I?m not making this up.

They weren?t the new neighbors, we?were; they?d lived in that house for many years- just not all in a row.

This family saved our family. I?m not just speaking of lofty goals of moral fortitude and keeping us from eternal damnation, I mean they saved our asses. These are people who understood exactly how difficult and complicated our lives had suddenly become, and helped us. All of us.

If more people had the love, good intentions, and right actions that these folks have, we?d be living in a different world. I look up to them and am so grateful for them all. They?re my heroes.

This week?s installment of Full-Assed Friday is a chat with Lindsey, the eldest daughter, who?was our main babysitter that first tumultuous year. From her I learned to use the phrase try to be a better listener, ?how to teach a kid that she?s choosing her own consequences by the behavior she chooses, and how to laugh a little more.

Lindsey was kind enough to come into the familiar chaos of our home and talk to me about growing up a missionary kid in Zimbabwe. Her story is fascinating and she?s passionate about where she grew up, so I?m splitting our talk into a two-parter. We?ll hear from her next Friday too.

When did your parents become missionaries?

In 1984, when I was two. My dad?s parents- my grandparents- were pioneer missionaries in the Zambezi valley- they made bricks out of mud, built their own roads, hunted for their food, that kind of thing. During that time the country was known as Southern Rhodesia, then several other incarnations (Rhodesia, Zimbabwe-Rhodesia, and finally Zimbabwe) up to the civil war. When my dad was a teenager, he helped unload wounded men from helipcopters and carry them to the hospital during the civil war.

My grandparents had every experience imaginable.

Once they encountered a lion the in the kitchen.

Another time, during the civil war, my grandma and grandpa were separated by an armed band of eight guerrillas. My grandma was coming out of the bath and was wearing just her robe when the knock came on their door. When they threatened her, she looked them in the eye and told them she wasn?t afraid.

Once a man crawled twelve miles to reach my grandma in hopes that she could help his festering ulcer. He had been taken to the local witch doctor but the ulcer ate away his flesh all the way to the bone and no one would help him anymore, so he crawled himself out to my grandma all that way to see if she could help.

A little girl had a snakebite that literally disintegrated her flesh until it fell off and only the bone was left. She came to my grandmother for help when no one else could help her.

There was a woman who came to her with an abscessed tooth. My grandma removed the tooth with a pair of pliers while another woman just held her head, no anesthetic, of course. A few days later my grandma got a magazine in the mail from the US- they took about six months to get there- and on the back cover was a picture of a tooth held in a pair of pliers that said ?impossible!? They got a good laugh out of that.

Did your father spend any time in the States as a boy?

My dad returned to the States every five years. He came back when he was a senior in high school. Having grown up in the strict British Colonial school system, he was horrified to see students with their feet up on the desks, tilting their chairs back. When the teacher entered the room, he stood at attention and called out the very proper, ?Good morning, sir!? and everyone looked at him and laughed.

Does your mother have a missionary background?

No.?Her father didn?t attend church, but her mother and siblings did, and they went to church regularly. A visiting missionary- not from Africa, but from somewhere else- came to her church when my mom was ten and it was a pivotal moment for her. She decided right then, at age ten, that she wanted to be a missionary in Africa.

She went on a couple dates with my dad in college but then kept turning him down when he asked her out because she had ?too much fun with him?. She kept saying, ?I?m not here to get my MRS degree!?

Somehow through winning a bet on a football game, my dad ended up with a free steak dinner for two and she couldn?t say no to that. And the rest, they say, is history.

After my mom brought my dad home for dinner to meet her parents while they were just dating, her father said to him, ?No daughter of mine is ever going to Africa!? She was mortified. Years later, he did in fact come out to visit them there.

You spoke of the civil war happening when your father was a boy. Can you give a brief synopsis of Zimbabwe?s political history?

Okay, but this is greatly simplified because it?s very complex. Before the Civil War, there were two opposing tribes: the Shona and the Ndebele. They gained independence in 1980. There was a transitional government with a British Prime Minister, which was passed off to a white minority government under Ian Smith. Then at independence there was?President Banana. Yes, that?s his actual name. Years later he was accused and convicted of sodomy.?Mugabe?was Prime Minister with President Banana but later became the president. Everyone was hopeful, and Mugabe seemed to be a true leader of the people.

After all, Zimbabwe is rich with coal, chrome, diamonds, tobacco, not to mention natural beauty that draws tourists like Victoria Falls, and it seemed like things could really turn around.

But since then there are accusations that the elections were fixed and Mugabe is said to have massacred 30,000 of the opposition. There is mass corruption and a 90% unemployment rate. When I was last living there, the life expectancy for women was expected to reach 27 years old. Currently the life expectancy is closer to 34. When I was there about 40% of the people were HIV positive, although the current infection rate is closer to 18%. There are few social services because historically it has been the extended family who took care of the orphans, the widows, the elderly. Now that they?re switching to a more urban way of living, there are few services in place to help everything that is falling through the cracks.

Largely it is aid organizations that are holding Zimbabwe together, but in many ways it can be debilitating. Without knowing the cultural dynamics of the country, the best intentions can be misplaced or misdirected. For instance, there was an aid organization with a generous personal donor who gave money for a well, including a pump, for an orphanage in Mozambique. But there?s this understanding there that if you have and we don?t, we take. So a well-intended donation- water for orphans- became a source of community conflict.

Zimbabwe is a very patriarchal society. Women are often viewed as less than second-class citizens and at times are treated as property. Elders are revered in traditional culture. But the economic situation is so bad that I personally have had more than one older man look me in the eye and beg for food for his family. This is something that under normal circumstances would never, never happen- an older man would never ask a young woman for anything. But people are starving. We keep a pretty big vegetable garden, so that we can always have something to give anyone who asks.

I remember starting in the 90?s we began having to wait in long lines for fuel. When word got out that a certain petrol station had fuel, they would release us from classes so we could go wait in line. There was a person whose full time job at times was seeking out and waiting for fuel for the missionary vehicles.

Zimbabwe had the highest inflation rate ever of any country not at war. The money was worth less than the paper it was printed on, and so people began trading and bypassing the use of money. Money would literally be blowing around the street and no one would bother to pick it up because it was worthless. Then they went to the US dollar but at first it was hard to translate the value of things. Like, a box of cereal would cost $14 but a candy bar was $22. And this, with an average monthly salary of $10.

Although there are well-educated and successful individuals in Zimbabwe, many of the unemployed people survive on subsistence farming, begging, or theft, because it?s the only way they can survive and feed their families.

We had many break-ins at our house. Ironically, they stole things like my Bible, my contemporary Christian music cassettes, my school uniforms.

The survey questioned 6000 people aged between 15 and 24 in 29 different countries. (In Egypt they were all married and aged between 22 and 30.) The results were presented on Monday ? World Contraception Day. The day?s motto: ?Live your Life. Know your rights. Learn about contraception.? The International Planned Parenthood Federation (IPPF) is one of the organisations behind the research. ?Millions of women in the world still have no access to contraception, although they would like to,? says IPPF?s Doortje Braeken. ?We?ve been trying to help young people avoid unplanned pregnancies and sexually transmitted diseases for a long time.? Biology In Europe, only half the young people surveyed said they?d had any sex education. In North and South America, Asia and the Pacific, the figure was 75 percent. But the youngsters often said the information they had received was inadequate. Doortje Braeken agrees with the criticism. ?Many young people get the impression that sex education is just biology. But that?s absolutely not what they want to know. They want to know about relationships, how to talk to each other. About relationships between men and women, about homosexuality. It?s not just about the risks and where your uterus is. It?s more than that,? the IPPF spokeswoman says. And strikingly, many young people said they didn?t trust their teachers when it came to information on sexuality, she adds. Double Dutch Doortje Braeken points out that the number of unplanned pregnancies is particularly low in the Netherlands, where since the rise of HIV/AIDS public sexual health information has promoted the so-called ?double Dutch approach?: the contraceptive pill used together with condoms. But in many countries, condoms are hard to come by, and only married couples have access to contraception, says Henk Rolink of Dutch sexual health and rights organisation Rutgers WPF. ?Sexuality is often a politically loaded subject which governments don?t want to burn their fingers on,? he says. ?What?s more, health care budgets are often very low. Like men, sexual health is an important aspect of your life. Although you may not think about sex or connect sexuality to your ego as men do, it remains a very important facet to quality of life. As a consultant to a dietary supplement company writing educational articles and practicing many years as a clinical psychologist, I have personally counseled and advised women on their sexual issues and endeavors for optimal sexual health. After years of experience in the field of psychology, I have come up with some practical recommendations for you to practice in order to optimize your sexual potential. Although written for a woman, men should read this article and support their female partner at all costs. Like many healthcare professionals, I believe in taking a holistic approach to sexual health and fitness.

The first step is to make your sexual fitness a daily goal. Just as frequent exercise is necessary for physical health, regular exercise and attention paid to your sexual being is vital. This is not to say you need to fixate on your sexual health and welfare as men do, but knowing yourself, your partner, and psychological well-being directly links to optimal sexual health. Just as you have a physical fitness regimen, so too should you devise a sexual fitness regimen. I do not mean you need to think and engage in sex as frequently as you exercise, but thinking daily about sexuality is not only healthy, I highly recommend it.

Physical well-being is paramount to your sexual health. This is why it is important to have an excellent open relationship with your doctor and/or gynecologist. There are many medical conditions that can impact a woman?s sexual well-being only she and her doctor can explore. From painful intercourse to a lack of sexual appetite, these problems can sometimes be rooted in a medical cause that can be treated with medication or doctor recommended steps. The key is feeling comfortable to discussing sexual issues with your doctor. There are millions of women who suffer from hormonal and medically based conditions. These same conditions though can be treated and sometimes cured with the help of a doctor.

Psychological well-being is crucial to your sexual health. Stress, anxiety, depression, and past traumatic experiences can all negatively influence sexual functioning. Just as a woman seeks medical advice from her doctor, a visit to a psychologist specializing in women?s issues may also be necessary to reduce mental health issues and past traumatic experiences from being problematic. A psychologist is a doctoral level clinician who is trained to diagnose and treat psychological issues which may impact a woman?s capacity to engage in sex in a comfortable manner. Although psychological conditions exist and require counsel, many women have emotional issues that can be addressed on their own or with a loved ones help. Unlike men, women seem impacted more by their environment than does their male counterparts. This is not to suggest men insulate themselves from their life stressors, but women tend to internalize these stressors more often and allow these life stressors to detract from their want, need, and desire for sexual engagement. Learning what life stressors are impeding their ability to practice regular sexual fitness can alleviate some of the obstacles causing sexual appetite and desire issues

As mentioned above, your sexual well-being is connected to the way you feel about yourself and the environment. Women are born, bred, and socialized to fixate on the way they appear to others. If you have a poor self-image or low self-esteem, it is almost impossible to engage in a healthy sexual lifestyle. It is truly unfortunate our society still places massive pressure on women to be thin, svelte, and seductive in appearance. Because of these societal expectations, women become far too involved in perceiving and feeling ?less than? or unattractive to others. This is not to say you should not exercise or practice self-image improvement, but the negative self-image a woman often feels when she?s not to the level she thinks she should be will always directly impact her ability to feel sensual, sexual, and provocative.

Whereas men tend to fixate on their sexual prowess, women seem to fixate on their image as it appears to the outside world. The goal is to reduce this fixation of being your most attractive at all times and then working towards self- acceptance. When you feel reasonably secure about your image, you become vastly more comfortable feeling as a sexual creature that not only deserves attention, but also expects sensual interactions. Speaking to a psychologist, friend, or loved one can help you meet the goal of a healthy self-image.

Women are socialized to be incredible communicators and adept at expressing their feelings. You learn early in development the benefits of discussing your concerns to others as being both healthy and necessary to optimal psychological well-being. Unfortunately, men are not socialized this way and tend to lack the confidence or motivation to communicate to their loved ones about their sexuality. Although men suffer this proverbial disability to discuss their sexual issues to others, women can also be hesitant to discuss sexual matters with others. The key for you is to feel comfortable expressing your sexual thoughts and concerns with the ones you are engaging in sexual practices with. Your male counterpart may not appear to be listening or concerned with your sexual needs. The secret reality is your male counterpart will usually welcome whatever advice you give him since his ego is connected to your sexual perception of him. There are men who truly are clueless about women?s needs and expectations, but if you believe in practicing sexual fitness, you will quickly educate him.

Self-awareness is essentially, ?Know Thy Self?. Despite religious and societal interpretations of masturbation and self-stimulation, it is highly recommended for you to know what arouses you sexually and helps puts you in a sensual mood. Self stimulation and masturbation is like exercise for the sexual senses. The more you know what arouses you, the better you will be at communicating to others what heightens your sexual prowess. The only way to communicate what your sexual trigger points are is to know what places on your body arouses you. Men have communicated to me in counseling on numerous times confusion about the female anatomy. They also confess they do not know how to touch and talk to their partner hoping to heighten her arousal. Women too often do not recognize what their sexual triggers are. Self-stimulation and masturbation helps you to recognize what arouses you and teaches how to identify the areas of your body that are sensitive to sensual touch. Masturbation not only educates a woman, but also has suggested in clinical studies to be a healthy behavior contributing to an increased sense of physical well-being. The more a woman is educated about her anatomy, and areas of sexual sensitivity can only positively contribute to her sexual life. The key is regularly practice self-stimulation as often as possible in order to achieve sexual fitness.

There are women who do not practice self stimulation or masturbation due to religious, philosophical, or for moral reasons. There are also women who do not practice masturbation because they simply don?t have the time due to work, children, or household responsibilities. When these reasons for not taking the time to practice self stimulation are apparent, then the next best thing is practicing sexual fantasy. There have been studies that have suggested men think about sex from every 10-15 seconds to every several minutes. There are no known studies that I have come across that have determined how often women think about sex. Although there may be these studies, I have not had the opportunity to review them. S. Fla. ICE chief held on child-porn charges

The head ofImmigration and Customs Enforcement for South Florida was arrested Tuesday after images of child pornography were allegedly found on his home computer, local media reported.

Anthony V. Mangione, 50, was arrested by U.S. marshals and taken to the Broward County Jail, according to jail records. He was expected to make an initial appearance in federal court on Wednesday.

Mangione was arrested on charges of possessing and distributing, authorities told The Miami Herald.

Federal officials remained tight-lipped about the arrest.

ICE officials referred questions to the Justice Department. A Justice Department official in Washington declined comment on the case. The U.S. Marshals Service did not return a call for comment.

Mangione has been on paid administrative leave since April when FBI agents searched his home and office as part of a child pornography investigation. Four images of child porn were found on his personal computer at his home in Parkland, The Miami Herald reported at the time.

The investigation continued and grew significantly over the summer, leading to the Internet-related, child-pornography charges being filed under seal, sources told The Miami Herald.

As special agent in charge of ICE?s South Florida office, Mangione has often praised the federal agency's efforts to fight child porn.

"Too many children are victimized by predators that target the most vulnerable among us ? our children," Mangione said in a 2009 press release announcing the sentencing of a 20-year-old Palm Beach County man on child porn charges, according to the Herald.

In a 2008 press release announcing the sentencing of a Martin County man to 10 years for using the Internet to entice a minor to engage in sexual activity, Mangione was quoted as saying: "This case reveals the disturbing truth that child predators will go to great lengths to sexually exploit minors," the South Florida Sun-Sentinel reported. "ICE is committed to identifying and arresting these individuals who seek to victimize children and help ensure that justice is served."

Mangione's area of command covered nine South Florida counties. He was responsible for overseeing investigations into drug smuggling, money laundering and financial crimes, commercial fraud, national security and cyber crimes, according to the Sun-Sentinel.

Mangione was reportedly planning to retire this summer. He has served his entire federal career with ICE and its predecessor, the U.S. Customs Service, according to the Herald.

Ancient ways and modern times

Reporting from the Sierra Juarez Mountains, Mexico?

In the high table land, a small, rawboned woman picks her way across ash and sand to a cave where she slept as a girl when her family came to harvest pine nuts every August.

Teodora Cuero is 90 years old, half-blind behind her sunglasses, with skin like crinkled wax paper.

She moves her fingers over the lichen-mottled rock, and the memories flood her with emotion. She talks of lost friends and family members, how they used to live.

Her friend Mike Wilken, an anthropologist, listens with rapt attention. What she describes are final scenes from the Indians' ancient yearly migration between the sea and desert, a pattern of life in Southern California and northern Baja long before the Spanish set foot here.

The territory of Cuero's people, the Kumeyaay, extended along the coast from what is today Carlsbad in the north, to the Santo Tomas Valley in Baja in the south, and over the mountains to the desert. The international boundary that was drawn across that terrain would put the tribe on separate trajectories. So unlike the many native peoples of Southern California whose language and customs were extinguished, hers found a measure of refuge in the remote, dusty valleys just south of the border.

Ancient ways remained not only relevant but necessary to get by in areas that had few staples from the modern world. They endure in many forms today.

No one embodies this more than Cuero, who didn't have shoes and spoke only Kumeyaay until she was a teenager, living 80 miles from downtown San Diego.

Today she lives in a rock house for which her husband traded a horse, speaks mostly Kumeyaay, cooks on an antique wood-burning stove in the garden, uses plant remedies for ailments and relies on food she gathers from the land to supplement her rice and beans. Goats andhorses roam the dirt roads of her village, La Huerta, which got electricity seven years ago.

Her life is not a simple snapshot of the past, but a complex amalgam of old and new. Cuero has a cellphone and refrigerator. She naps on a bench seat extracted from a recently deceased Ford pickup. She drinks inky black coffee and smokes Marlboros.

Over the last three years, Wilken has worked with Kumeyaay elders like Cuero to document their language and those traditions they adapted to the times. His material goes to a National Science Foundation project on documenting endangered languages and a museum in Tecate he helped establish.

"There are certain stories people want to hear about the Indians," Wilken said. "That they are living a way of life that hasn't changed in thousands of years. They want to know about shamans and go to a sweat lodge. We have to get over some pre-formed idea of who they are and experience them as they are."

He began working with the Kumeyaay 15 years ago as an "applied" anthropologist, meaning he not only studied them but worked with them to make endangered traditions more useful to them. He helped find markets for their basketry and native medicines, and arranged cultural exchanges with the Kumeyaay in the United States, who wanted to learn more about their heritage.

"When people from the California communities meet Kumeyaay from Baja they say, 'This is how we lived 50 or 100 years ago,' " Wilken said.

The Kumeyaay greeted the first Spanish expedition in California in 1769. They had been here for at least 1,300 years, anthropologists say, maybe many thousands more. The Kumeyaay lived in temporary brush huts and moved throughout the year in search of food.

While many ended up in the Spanish missions and later on reservations, many others did not.

Into the early 20th century, clans of outliers still roamed the margins of the expanding Yankee society, following their old trails, speaking little English or Spanish and crossing the border without even knowing there was one.

Their exile was searingly documented in the autobiography of Delfina Cuero, who was born near Jamul in 1900 and told her story to an anthropologist in the 1960s.

As a child, Delfina, a cousin of Teodora Cuero's father, followed her parents around San Diego County, looking for ranch work while hunting and foraging. They collected shellfish and crabs on the rocks of Point Loma. They speared fish in the coastal waters and harvested greens and roots from the black mud of what is now called Mission Bay.

(AP) ? Music and media companies are pinning fresh hopes for reviving their businesses on a small ribbon that Facebook has begun putting on user profiles called the "ticker."

The new, slim stream of updates automatically lists users' activity on a range of apps made for listening to music, watching movies, reading news and playing games. The updates come after users consent to the continuous sharing just once.

Clicking on your friends' items in the ticker can lead to automatically being signed up for free trials on services such as music plans Spotify and Rhapsody, many of which may eventually ask for a monthly fee.

While the new feature is billed as a way of fencing off a huge volume of information on what you're doing, for the businesses involved, this passive way of sharing is a giant viral marketing machine.

Axel Dauchez, the chief executive of music subscription service Deezer, said the integration with Facebook is key to his company's plan to roll out in more than 130 countries other than the U.S. over the next several weeks. Deezer has 1.4 million paying customers in France and the U.K.

Facebook users who click on links of songs that friends are playing on Deezer are automatically signed up for a two-week trial with accounts that use their Facebook preferences. Then they are able to listen to their friends' picks in real time or later at their convenience.

Dauchez said he hopes the system spawns a "revolution" in how people listen to music, although it remains to be seen if more people end up paying for 5-euro- and 10-euro-per-month subscriptions.

"Reality will tell me if I'm right or wrong," he said.

In introducing the new system at a developers conference in San Francisco that was viewable online, Facebook CEO Mark Zuckerberg described the sharing as being part of a new product called the "timeline," saying "apps help tell the story of your life." The new system will result in "an order of magnitude more" posts than before, he said. Apps will come with their own set of privacy controls and previous posts can be manually deleted.

Several companies said the new sharing system would help users discover music, news stories, movies and TV shows.

Netflix Inc. CEO Reed Hastings, said knowing that a Facebook friend has watched something is more compelling than his company's own recommendation technology, which is based on one's own past viewing behavior. He said because a friend of his watched AMC's "Breaking Bad," he finally got around to seeing it.

"Watching content because my friend did really trumped the algorithm," Hastings told the audience.

Netflix's integration will only be available in Canada and Latin America because an obscure law impedes a U.S. launch for now. Non-members will be prompted to sign up for a free month-long trial if they click on what a friend is watching.

Video service Hulu also launched an app that helps sell its $8-a-month Hulu Plus subscription. While there is a range of free TV and movie content, users who click on a friend's video that is normally reserved for paying customers will be able to see only a 90-second preview before being informed how to sign up for the pay version.

Daniel Ek, founder of music subscription service Spotify, told Facebook developers at the unveiling that the deeper integration will help the world "light up with music." Since its launch in the U.S. in July, the Swedish company has boosted the number of paying customers to more than 2 million globally from 1.6 million previously.

Spotify charges $10 a month for unlimited access to tracks on mobile devices, but a PC-based version is free in the U.S. with no caps on usage for now. Clicking on friends' passive posts puts a program on one's computer that plays back the song.

Freeing people from the hassle of actively sharing songs they like will help keep people engaged in their friends' listening habits without effort, said Spotify's chief content officer, Ken Parks. "Anything that brings the friction out of that is great for everybody," he said.

Rhapsody, a competing $10-a-month unlimited mobile music service, announced it would allow Facebook users 30 days to try out their service, even on mobile devices. Competitor Rdio is giving users a free 7-day trial on mobile devices too.

"The more you help people discover music, the more social it is, the more they will be engaged," said Rhapsody president Jon Irwin. "If they're more engaged, then they're more likely to subscribe."

Facebook continues to add users and has 800 million globally so far. That has made it a huge director of traffic on the Web, and now its display advertising business is bigger than online news giant, Yahoo Inc., according to eMarketer

That's one reason news media companies are jumping on board.

Yahoo developed a way to let Facebook users know what stories their friends are reading after logging in. A running tally of stories friends have clicked on appears at the top of the page. The plan is to start the integration with the news section on the U.S. site and expand it into the sports, finance and entertainment sections next year.

The Washington Post launched an app called a Social Reader that creates unique front pages that pull from multiple sources based on what you and your friends are reading. Washington Post Co. CEO Donald Graham said the plan is to draw a big audience but not put advertising in the app for now.

"What do newspapers need right now? Great journalists and great technologists," Graham said. "We have plenty of great journalists and they have the great technologists."

Murder conviction could be tough in homeless death (AP)

LOS ANGELES ? A suspect pulls on a pair of rubber gloves, tells a mentally ill homeless man he's about to attack him, then initiates a beating that ends in the man's death.

Any prosecutor might ordinarily be confident of a slam-dunk murder conviction, especially when the beating is captured on video and audio recordings.

But when the suspect is a police officer, all bets are off.

Authorities charged a Fullerton police officer with murder Wednesday amid those circumstances, but legal observers said murder convictions for on-duty police killings are exceedingly rare, primarily because courts and jurors have an innate sympathy for law enforcement officers, even when video or audio evidence depicts a killing in graphic detail.

"Jurors are reluctant to find murder when it is not a cold-blooded, premeditated killing," said Dane Ciolino, a law professor at Loyola University in New Orleans. "Unless they think the officer woke up, put on his boots with murder on his mind, it's difficult for prosecutors to prove a case."

Orange County prosecutors charged Officer Manuel Ramos with second-degree murder and involuntary manslaughter in the July 5 confrontation with Kelly Thomas, a 37-year-old homeless man with schizophrenia. Police Cpl. Jay Cicinelli was charged with involuntary manslaughter and excessive force.

Cicinelli has pleaded not guilty; Ramos has yet to be arraigned.

Ramos was responding to reports of a homeless man burglarizing cars at a transit hub in suburban Fullerton, a college town of about 135,000. Though Ramos already knew him, prosecutors say the officer escalated a routine stop-and-search to a bloody attack against Thomas, who appeared to be having difficulty following commands.

Ramos was wearing a digital audio device that captured the exchange, in which prosecutors say he told Thomas he was going to "F him up."

Prosecutors say Ramos started the beating then five other officers who had not seen the start of the confrontation joined in. In the 10-minute incident, Thomas was shocked four times with a Taser, kneed in the head, punched in the ribs and bashed eight times around the face with the butt of a stun gun as he cried out for his father and begged for help as Ramos laid on top of him, authorities said.

"That is not protecting and serving," Orange County District Attorney Tony Rackauckas said.

The coroner concluded the cause of Thomas' death was mechanical compression of the thorax, which made it impossible for Thomas to breathe normally and deprived his brain of oxygen, Rackauckas said. Other injuries to the face and head contributed to the death, he said.

Despite the circumstances, legal experts were skeptical Ramos would be convicted of the murder charge. They could recall few examples of such a charge ever sticking in court.

"It is very rare for a police officer to be charged criminally for the use of excessive force," said Lorie Fridell, an associate professor of criminology at the University of South Florida. "You have to remember these officers are walking a fine line in their use of force. They need to use enough force to effectuate their protection in taking a person into custody. But if their judgment is wrong, they are facing allegations of abuse."

In California, former transit agency officer Johannes Mehserle was initially charged with murder for fatally shooting Oscar Grant on an Oakland train station platform on New Year's Day in 2009. Multiple passengers on the train videotaped the killing, which sparked riots in the city.

Mehserle said he mistakenly fired his handgun instead of his Taser. A jury eventually convicted him of involuntary manslaughter and he served a year in jail.

Jurors and courts "tend to give officers more leeway in a use-of-force case," said Mehserle's attorney Michael Rains. "The courts talk about how we need to look at the conduct based on the state of mind ... at the time and not on 20/20 hindsight from today."

In 1996, New Orleans police officer Len Davis was convicted of capital murder for ordering a hit on a woman who filed a brutality case.

Last year, former New Orleans police officer David Warren was convicted of manslaughter for fatally shooting a man in Hurricane Katrina's aftermath. Another officer was convicted of burning the man's body in a car.

And in the same city, a federal jury convicted a group of current or former police officers in deadly shootings on a bridge less than a week after the hurricane. They were convicted of civil rights violations in the shootings that killed two people, but the killings were found not to have been murders.

Ramos' attorney, John Barnett, has disputed the district attorney's account of the confrontation with Thomas. He says when his client snapped on a pair of latex gloves and made a threat, he was using a subtle type of force to get a suspect to comply.

"It was an attempt by the officer to use words not force to get the suspect to do what he's supposed to do," Barnett said.

Barnett previously defended a Los Angeles police officer who was charged with murdering an unarmed truck driver. A judge eventually dismissed the case.

Bill Hadden, Cicinelli's attorney, declined to comment.

Thomas' death generated furious protest against the Fullerton Police Department, with hundreds of residents demanding the chief's departure and swift action against the officers.

The other four officers remained on administrative leave and were not expected to be charged. The district attorney said there was no evidence to show they knew what had happened between Ramos and Thomas when they arrived on scene and may have thought they were helping subdue a dangerous suspect.

A second-degree murder conviction carries a maximum sentence of up to life in prison. The charge is less serious than first-degree murder, where prosecutors must usually prove some level of premeditation or nefarious motivation.
