Someday soon, in addition to the familiar refrain heard on radios and TVs ? "This is a test of the emergency broadcast system" ? you may also see this on Facebook: "This is a test of the Disaster Message Board."

Recently in Japan, Facebook tested the new feature, aimed at consolidating some basic communication in the event of an emergency. The test only lasted two days, from Feb. 28 to Feb. 29, so the page is no longer available. (It is already March 1 in Japan, which suffered a cataclysmic earthquake and tsunami almost a year ago.) But the?Yokkaichi, Japan-based?Yosoko News grabbed shots of it before it was gone and shared the images.?

A disaster in your area would trigger an announcement from the board to pop up above your news feed. Then, you would be able to tag yourself as "Safe" and also check friends to see if they are OK, too. (Friends' location and current status would pop up next to their names, eliminating the need to go to their profiles to check.) You can then go to the board to contribute information to the conversation.?

As long as most people you know and want to check on are on Facebook, this seems like it'd be a good one-stop tool to make sure they're unharmed, and to let others know you're fine.?

Until that board goes live, Facebook has its Global Disaster Relief resource center as a go-to site for tips. There are also plenty of apps available from the American Red Cross and others that help connect people during crises. ?

Apple's proposal for licensing Motorola's standard-essential patents ...

In the aftermath of yesterday's key decision by a German appeals court on a Motorola v. Apple injunction, I did a follow-up post today proposing that Google and Motorola should now pursue licensing, not litigation. I have seen the debate continue in many other places, of which I'd like to highlight two:

• I agree with AllThingsD's John Paczkowski that Motorola is engaging in reality distortion by claiming victory based on yesterday's decision. I'd like to add a couple of "local" observations:

  1. One, the final paragraph of the court's press release makes clear that the current opinion of the court is that Motorola is committing an ongoing violation of antitrust law. That's nothing to be proud of or happy about, especially not in light of the fact that the European Commission will soon decide on whether to launch formal investigations further to Apple's and Microsoft's complaints over Motorola's alleged FRAND abuse. Many other companies in MMI's place would now read the writing on the wall and accept Apple's licensing proposal in order to defuse the antitrust situation.

  2. Two, if the appeals court recognized that Apple made a binding offer to take a license and pay FRAND royalties (of an unspecified amount, as I'll explain in this post), that's nothing new. When the same appeals court denied Apple's previous motion for a suspension of the injunction on January 23 (a fact that shows that winning such a stay is not a routine thing in Germany at all), it already recognized the same fact. At the time, the outcome-determinative objection to Apple's motion was a lack of clarity concerning the exact implications of a future challenge to the validity of MMI's relevant patents -- not a lack of an offer to pay royalties.

• The Korea Times reports today that Samsung CEO Choi Gee-sung (a courageous and ambitious business leader) appears less confident about further developments in Samsung's litigation with Apple, and quotes an unnamed senior Samsung executive saying that the company's "legal experts are closely studying the possible effect of Apple's recent legal victory against Motorola". Indeed, the defense that worked for Apple against Motorola could also be invoked against Samsung if necessary. So far, however, Samsung hasn't proven Apple's infringement of any valid Samsung patent in Germany. Whenever it achieves this in connection with a standard-essential patent, Apple can use the same strategy as in the Motorola case to avoid an injunction.

Also, while this speech was almost certainly written before yesterday's Karlsruhe decision, European Commission Vice President Almunia told members of the European Parliament today that "hold-up" based on essential patents is not acceptable. The related article doesn't specifically mention the word "standard-essential", but the context is clear, especially in light of how the Vice President's recent statement on Google-Motorola highlighted the issue that standard-essential patents can no longer be worked around once they become a mandatory part of a standard (prior to that elevation, they can still be worked around like any other patent, such as slide-to-unlock).

Three examples of how the FRAND subject continues to make headlines. And it probably will for some more time.

In follow-up discussions today (with different, independent people whom I hold in the highest regard) I realized that something I previously said about Apple's proposal to take a license to Motorola's standard-essential wireless patents has largely gone unnoticed, simply because there's so much going on and the information was conveyed in the middle of a very long blog post on Apple's iterative approach (of repeatedly amending its licensing proposal). Some people were wondering how much less than Motorola's well-documented 2.25% royalty demand on the selling price of entire devices (see the "Common Royalty Base" part of this recent blog post) Apple may have offered to win yesterday's suspension of the enforcement of Motorola's injunction. The answer is that Apple has not offered any particular percentage. It has just committed to pay whatever a court would consider to be a FRAND royalty.

I've been watching (by reading court documents and attending different trials) the evolution of Apple's proposal to MMI for some time. I can rule out that Apple has offered a specific percentage. Under German law, it doesn't have to. In order to satisfy the German Orange-Book-Standard criteria, it's sufficient to commit to paying a FRAND royalty. I did report on this in the aforementioned long blog post on Apple's iterative approach, but I should have reiterated this in the meantime. This link leads to the relevant section of that post:

The issue in this iterative process is not that they have to agree on a particular percentage for future royalties. Under Orange-Book-Standard, a would-be licensee can either offer a particular royalty rate or can leave this determination to the courts (technically, the patent holder is then free to determine the amount in his reasonable discretion, but subject to judicial review and, if necessary, adjustment). Leaving the exact royalty amount open is the path Apple has, not surprisingly, chosen.

There wasn't any indication at any of the trials I watched or documents I read that indicated that Apple changed its approach and offered a specific percentage or amount. Otherwise the appeals court would have had to comment, in its ruling, on the appropriateness of whatever Apple would have proposed. But it didn't.

Under German law (not just patent law but also in other fields), it's fairly common to agree on an obligation to pay something without specifying the amount beforehand. I've signed such agreements myself. The legal basis for this is Article 315 of the German Civil Code, which basically says that if an agreement lets the beneficiary of a payment or other consideration unilaterally determine what he is owed, then this discretion must be exercised in a fair and reasonable manner, and any such demand can be adjusted by a court of competent jurisdiction if need be. This enables parties to conclude an agreement and recognize, in principle, certain obligations even before they are able to agree on, for example, the amounts of future payments. They can enter into a binding agreement and sort out such questions later.

In a case like Motorola v. Apple, this is helpful because it enables Apple to create a situation in which Motorola is barred from pursuing injunctive relief (otherwise Apple and Motorola would never agree, or Apple would have to pay far more than it believes a court would consider appropriate). In other cases, the Art.?315 approach comes in handy because the parties may not be able to foresee the future circumstances under which an amount has to be determined. For example, if parties agree on a contractual penalty and the range of how severe a formal breach of contract may be is very wide, there's no single amount that they can agree upon ex ante, but they can agree that certain misconduct must have consequences and rely on the ability of a court of law to determine an appropriate amount ex?post if they fail to agree on it without judicial help.

There's no doubt that Motorola will try to get as much out of Apple's unspecified FRAND commitment as possible. But at this stage, it appears that Motorola has not yet accepted Apple's proposal anyway, so it can't trigger the process that would result in a court's determination of the royalty rate. If Motorola at some point does accept Apple's proposal (it might come under pressure from antitrust regulators who probably won't tolerate the current situation forever), it can then certainly try to convince German judges that the royalty should be significant. I explained that in a section on the German situation in my post earlier today on Google's and Motorola's worldwide tactical options. This is unlikely to be so much of a threat to Apple that it can tip the scales in the wider dispute. If necessary, Apple will pay what it has to pay, but it won't have an obligation to grant Motorola a license to any of its own non-essential patents.

So far, Microsoft's German proposal to Motorola (concerning MMI's patents on the H.264 video codec standard) is different from Apple's in the sense that it does specify a particular per-unit royalty amount. At the trial I had the impression that Motorola's 2.25%-of-price-of-device demand was not really viewed by the court as a realistic position. We will see how that case evolves. Differences like this aside, yesterday's ruling is also very helpful to Microsoft because it shows that the Orange-Book-Standard bar isn't infinitely high once these issues are put before senior German judges.

Because this particular aspect is tricky especially when you are trying to keep your podcast short, it is important to be prepared, don?t ramble and keep everything precise and to the point.

If you are a newcomer to podcasting, it can take some time before you seeing quality results, but once you begin to do it regularly, you will understand that you will need to make a commitment to offer quality content consistently to be able to succeed. However, there?s no doubt that you can derive massive exposure and build a really strong relationship with your target audience by simply focusing on improving the quality of your podcast, and getting it right.

Of course we all know that nothing is perfect or applicable for everyone, but for online marketing today?s discussion has far-reaching implications. We will be very hard pressed to ever believe a business cannot take an additional technique and make it work for them. FBI deactivates about 3,000 GPS tracking devices, loses sight of your car

Following a January ruling by the US Supreme Court, the FBI has deactivated some 3,000 GPS units that were potentially infringing on the Fourth Amendment. The decision seems to be making waves in the U.S. Justice Department. Andrew Weissmann, FBI General Counsel, says some of the devices have been difficult to retrieve, as the vehicles they were once tracking now move undetected. The FBI has sought temporary permission to reactivate some of the devices to locate and retrieve the hardware. Weissmann says the FBI is also developing new guidelines regarding the legality of its agent's actions -- from the application and use of tracking devices, to the extent a suspect's garbage can be searched before the agent is committing trespass. In short, the FBI is working really hard not to violate your legal right to privacy. If you happen to find something weird under you car, give 'em a call. They'd probably like it back.

PYONGYANG, North Korea (AP) ? A renowned conductor from South Korea is in Pyongyang to rehearse with North Korean musicians before their upcoming performance in France.

Maestro Chung Myung-whun of the Seoul Philharmonic Orchestra landed in the North Korean capital on Tuesday.

Chung is to rehearse with North Korea's Unhasu Orchestra before they head to Paris for a rare joint performance with the Radio France Philharmonic Orchestra next month.

Chung had been seeking to organize joint performances involving musicians from rival North Korea and South Korea. Instead, he arranged to bring the North Korean orchestra to France, where he also serves as music director for the Radio France Philharmonic.

The two Koreas do not have diplomatic relations, and the Korean peninsula remains in a technical state of war.

Attorney General Gansler Challenges Google on New Privacy Policy Comprehensive integration of consumer data may compromise privacy

Baltimore, MD (February 22, 2012) - Attorney General Douglas F. Gansler today sent a letter to Google Chief Executive Officer Larry Page outlining multiple concerns regarding Google's recently announced changes to its privacy policy and requesting a meeting with Mr. Page as soon as possible. 35 other states and territories joined in the letter. Google has been given a week to reply to the request.

The policy changes, scheduled to automatically take effect for all users of Google products and services on March 1, 2012, invade consumers' privacy by unilaterally allowing Google to raid information it collects when a consumer uses one Google product and share it with all other service and products offered by Google. Individuals who allow Google access to certain information as part of using one service will now, whether they want to or not, be giving Google authority to use that information for all its services and products. Users who would like to use one Google product without allowing Google to access the information provided when they use another Google service will generally not be able to do so. The new policy also potentially heightens the risk of identity theft and fraud, since Google will now be storing far more comprehensive, consolidated personal information profiles.

"I am deeply concerned about Google's effort to push a major privacy change on consumers without giving them the choice to opt in, or at a minimum the opportunity to opt out," said Attorney General Gansler. "After years of touting its commitment to meaningful privacy choices for its users, Google should abide by its claimed privacy principles and let consumers decide whether to say 'No thanks' to a new policy."

Under the new privacy policy, Google gives itself the freedom to combine users' personal information from services like Web History and YouTube with all other Google products, and precludes existing users from fully opting out of this policy change unless they cease using the Google ecosystem entirely. Given Google's robust Internet market share across platforms, Internet users must acquiesce to diminished privacy or be cut off from a vast portion of their existing Internet experience.

For millions of consumers who use Android-powered smartphones, currently estimated to be 50 percent of the national smartphone market, ramifications of the new privacy policy will be virtually impossible to avoid Users of these smartphones must log in to Google to activate much of the functionality of their devices. They would now have to choose between either frequently logging in and out to avoid Google's consolidation of their data, thus greatly reducing the efficiency of their smartphones, or replacing their smartphones at great personal expense.

Threats to consumers' privacy go beyond the consolidation and use of personal data. Consolidated personal data profiles offer a tantalizing target for hackers and privacy thieves. As stated in the letter to Google authored by Attorney General Gansler on behalf of his Office and the other 35 signatories:

"Those consumers who remain in the Google ecosystem may be making more of their personal information vulnerable to attack from hackers and identity thieves. Our offices litigate cases of identity fraud with regularity and it seems plain to us that Google's privacy policy changes, which suggest your company's intent to create richer personal data profiles, pose the risk of much more damaging cases of identity theft and fraud when that data is compromised, a risk that will grow as instances of computer hacking grow. With this newly consolidated bank of personal data, we foresee potentially more severe problems arising from any data breach."

The Attorneys General recognize there may be consumers who welcome the consolidation and indiscriminate sharing of their personal information and data across multiple platforms. Unfortunately, many more consumers will either dislike the consolidation or not realize the potential harm that comes from it. Consumers deserve a full accounting of how this new privacy policy may impact them, and a meaningful opportunity to avoid being subjected to it.

Given the serious concerns expressed on behalf of those consumers, the Attorneys General have requested a meeting with Google Inc. CEO Larry Page as soon as possible. Mr. Page has been asked to reply no later than Wednesday, Feb. 29. This quick response is needed in order to enable the Attorneys General to review Google's accounting before the new privacy policy goes into effect.

The states and territories signing on to this letter include: Arizona, Arkansas, California, Connecticut, Delaware, the District of Columbia, Guam, Hawaii, Illinois, Indiana, Iowa, Kansas, Kentucky, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Montana, New Hampshire, New Mexico, New York, North Carolina, North Dakota, N. Mariana Islands, Pennsylvania, Puerto Rico, Rhode Island, South Dakota, Tennessee, Texas, Utah, Vermont, the Virgin Islands, and Washington.

Windows Phone Showing Signs of Life, Thanks To Nokia

Despite mostly positive reviews and a steady increase in the number (and quality) of apps available for the platform, Windows Phone has performed poorly in the marketplace. We have posted a number of stories right in this space dealing with Windows Phone?s lackluster performance and what steps we thought Microsoft should take to get Windows Phone on track, none of them more cynical than one titled, ?Analysts Claim Windows Phone Will Outsell iOS By 2015?. In that post we talk about a claim made by analysts at iSuppli that said Microsoft and Nokia?s strategic partnership would result in huge sales increases, which would ultimately result in Windows Phone overtaking iOS by 2015. Just typing that sentence again still makes us raise an eyebrow. The latest news to come out of Strategy Analytics, however, seems to lend some credence to iSuppli?s bold prediction.

According to recent data, Strategy Analytics claims that?in a single quarter?Nokia has become the largest Microsoft Smartphone vendor in the world, surpassing companies like HTC and Samsung in the process. In Q3?11, Nokia?s Windows Phone global marketshare was 0.0%. By the end of Q4?11, however, Nokia?s global marketshare in the space surged to over 33%.

The numbers put forth but the Strategy Analytics report also show a 36% increase in Windows Phone shipments. Total shipments remained under 3M units, however, which is still a small fraction of the number of Android and iOS-based devices shipped. Still, the news is good for Microsoft and Nokia.

Neil Mawston, Executive Director at Strategy Analytics said, ?An expanded portfolio of Windows Phone 7 models such as the Lumia 800, an increased retail presence and highly visible marketing campaigns across several European and Asian countries drove Nokia?s growth. Nokia is by no means out of the woods yet, and it is still on a long road to recovery, but capturing top spot in the Microsoft smartphone ecosystem is an encouraging baby-step forward for the company.?

We?d have to agree with that statement. Nokia and Microsoft still have a long way to go, but the two companies seem to have laid a solid foundation on which to build. With consistent advancements on both the hardware and software fronts, intelligent marketing, and the launch of Windows 8 looming, a major shakeup in the smartphone and adjacent mobile markets could be afoot.

Slow video streaming can frustrate and spoil your online viewing experience. The Slam Dunk field of competition lacked the star power of years past with Derrick Williams, Chase Budinger, Jeremy Evans and Paul George vying for the throne.

All four were participating in their first dunk contest.

Another first for the event was the introduction of a single round format with each participant granted three dunks. ?The winner of this year?s event was chosen strictly by the fans.

Round One

Budinger started the show with a very strong and well played reference to the film ?White Men Can?t Jump? reprising Woody Harrelson?s famed role of Billy Hoyle by jumping over music mogul Sean ?P-Diddy? Budinger started round off the second round with a similar dunk to Williams? first, minus the motorcycle.?

Evans found redemption, after an uninspiring first round, by dunking two basketballs after an alley from a seated Gordon Hayward, his Jazz teammate. This was hands down the dunk of the night.

In another show of creativity George had all of the lights in the arena turned off to reveal his glow in the dark Pacers uniform. George connected on a very solid 360 dunk which drew cheers from the crowd.

Williams also impressed on his second dunk attempt by rocking the rim on an off the side of backboard dish from T?Wolves teammate Ricky Rubio for a two handed 360 jam. This dunk was similar to the one 2011 champion Blake Griffin attempted, but couldn?t pull off. Credit to Williams for getting it done in style. ?

Round Three

Former dunk champion Cedric Ceballos came out to support Budinger on his third attempt, a blindfolded reverse two handed slam with the crowd instructing Budinger on when to ?jump? for the attempt since he was blindfolded. ?

Comedian Kevin Hart, playing a mailman, delivered a Karl Malone Utah Jazz jersey to Evans before his third attempt. Evans pulled the tribute dunk off, the Malone pose, just inside the paint over a standing Hart.

George paid tribute to the legendary Larry Bird by placing a sticker of the legend?s face on the backboard before throwing down a slam from the baseline.

Rumours of Apple's iPad 3 have reached fever pitch, as photos and documents claiming that the new tablet is already being shipped from China to America have surfaced.

Reported by Apple blog 9to5Mac, a photograph claims to be of iPad 3 stock being loaded onto a freight plane in China, along with documentation believed to be related to cargo which has unusually high levels of security surrounding it.

The shipping documents relate to a delivery from Foxconn - the company that produces iPhones and iPads for Apple - to three of America's largest airports. The deliveries reportedly began on 26 February.

A commenter on the Chinese site Apple.pro said, translated by machine, said: "Our company started undertake a load of top-secured cargo. The owner has extreme requirements for the security.

"Additionally, our sources pointed to the discontinuation of all iPad 2 Wi-Fi + 3G models and all iPad 2 Wi-Fi-only models (except the black and white 16GB units-at least initially) when the iPad 3 launches."

This would suggest that Apple will continue to sell the cheapest iPad 2 - presumably at a reduced rate - alongside the iPad 3, as the company has done successfully with the iPhone 3G S and 4 alongside the iPhone 4S.

Wynn said it will pay $1.9 billion over 10 years, a 30 percent discount over his stake's current market value of $2.77 billion. On Tuesday, Wynn Resorts fired another round at Okada, suing him for misappropriating company trade secrets for use at the $2 billion resort Universal Entertainment is developing in the Philippines.

Wynn Resorts said its decision to reclaim Okada's shares is based on the results of a year-long investigation conducted by former FBI Director Louis Freeh on the company's behalf. The report accuses Okada of paying over $100,000, mostly in travel accommodations, to Philippine gaming regulators. It also suggests there may be other other instances of impropriety with South Korean regulators.

"Mr. Okada and his associates and companies appear to have engaged in a longstanding practice of making payments and gifts to his two chief gaming regulators at the Philippines Amusement and Gaming Corp., who directly oversee and regulate Mr. Okada's Provisional Licensing Agreement to operate in that country," Wynn Resorts said in a statement. "As directors of a gaming company privileged to hold licenses, we have a duty to uphold the highest ethical standards and comply with the laws and the terms of the licenses upon which our business depends." The statement also said that Okada is the only member of the board of directors who has refused to sign the company's Code of Conduct.

Universal Entertainment responded by saying it will fight the forced redemption of its shares in court. "The decision by the Wynn board, which followed a rushed investigation that lacks absolute findings, to redeem Universal Entertainment's nearly 20 percent holdings in Wynn Resorts based on its project is outrageous," Okada said.

Wynn Resorts also closed the Okada Japanese restaurant in the Wynn Las Vegas and removed all references to it from the hotel and the company website.

The judge, however, sided with Canpartners, citing differences between bankruptcy sale rules and foreclosures.

Canpartners, a division of Los Angeles-based investment company Canyon Capital Realty Advisors, plans to find a licensed gaming operator to run the property. The sale is expected to close by the end of March.

MGM Resorts International announced on Tuesday that it signed a deal to develop a nongaming version of the Bellagio hotel in Shanghai, China. The company has been expanding its international hotel operations for several years, even changing its name to promote a reputation as a luxury non-gaming resort operator.

One of MGM's joint venture companies, Diaoyutai MGM Hospitality Ltd., will partner with the Suning Real Estate Group to build the Bellagio Shanghai Bund hotel along Shanghai's Huangpu River. MGM promises the new Bellagio will have all the high-end retail and entertainment excitement of the Las Vegas version even though there won't be a gaming floor. Construction is expected to be complemented by 2015.

"This strategic partnership with Suning further extends our reach into China, one of the fastest-growing hospitality markets in the world," said MGM CEO Jim Murren. "Along with our Diaoyutai JV partners, we believe relationships like this with Suning create new opportunities to expand our brand reach into this strategically vital marketplace."

Diaoyutai MGM, a joint venture with Diaoyutai State Guest House, already runs the MGM Grand Sanya resort on China's Hainan Island and is developing two hotel sin Beijing. The MGM Grand Tianjin and Skylofts of MGM Grand Tianjin are under construction and will open in 2014. The MGM Grand Chengdu and Skylofts are expected to open the same year.

Thousands protested today the burning of Qurans and other religious texts at a US military base in Afghanistan.?

Thousands of protesters rallied outside the Bagram military base in Afghanistan today after NATO and US officials reportedly burned Qurans, the Muslim holy text. The Qurans, along with other books, were removed from a library at a nearby detention center reportedly due to extremist messages penned inside the books and exchanged among detainees, reports the Associated Press. US and NATO representatives apologized and promised an investigation into the event.

The burning of the Quran has?angered Afghans in the past, sparking deadly protests in 2010 and 2011. But if discarding a Quran is necessary, there are respectful and acceptable ways to do so, scholars say.

It is important to give a Quran a proper burial, says Omid Safi, professor of Islamic studies at the University of North Carolina and author of ?Memories of Muhammad.? Any text containing ?the name of God is sacred in Islam. God is revealed through scripture, and anything associated with writing it has a religious significance, Mr. Safi says.

One could literally bury the Quran, ideally in a place with little foot traffic. Another option is to put the book in a flowing body of water, either letting it sink or be carried away. Regardless of the method, treating the book?s destruction with respect is paramount. Safi likens it to a poor man?s funeral, where the book might be wrapped in a shroud before being placed in the ground and mourned.

Burning the Quran, however, is also an accepted practice.

?People often ask, ?if it?s OK for Muslims to burn the Quran, then why isn?t it OK for the US military to do it??? Safi says. ?That?s where the question of symbolism is important.?

Some say erasing the names of God and his messengers prior to burning the Quran makes it acceptable, but Safi says it?s even simpler than that. It comes down to context: Burning the text in a dumpster with trash on a US military base feels less respectful than treating the disposal with reverence in a burial or sacred burning.?

Safi finds one analogy particularly helpful: The Quran is to Islam as Jesus is to Christianity. ?In an Islamic universe ... the word becomes not a person, but a book,? he says. ?For a Muslim to see the Quran burnt not as a way of burial, it would look and feel like someone burning Jesus, or a crucifix.?

But contextualizing today?s protests goes beyond simple reverence for the Quran, Safi says. ?Bagram airbase is one of the central places of US military presence in Afghanistan ... [and] between 600 and 700 Afghans have been detained or are being detained there for years and years.? ?

Safi says this isn?t so much a theological debate on how to dispose of the Quran properly, but a charged conversation around a military force ?that?s being looked at as an occupying force ... [A]n unlawful, violent force.?
