Golf clubs must improve course safety in wake of liability case

The Scottish Golf Union (SGU) issued a warning about on-course safety after the controversial case, which was destined for the Supreme Court, between Niddry Castle Golf Club in West Lothian and two golfers was settled.

Anthony Phee, who was a visitor to the course, lost an eye after being hit by a ball struck by fellow amateur player James Gordon ?in 2007.

Mr Phee was awarded ?397,034.82, with Mr Gordon liable for 70% and the club 30% due to its "failure to place signs at appropriate places".

Niddry Castle appealed the decision, arguing that 30% liability was unfair. But the appeal court in Edinburgh disagreed and substantially altered the award, finding the golf club 80% liable with just 20% liability attributed to Mr Gordon.

In its emailed communiqu? the SGU warned: "The recent decision of the Inner House of the Court Session on Phee v Gordon and Niddry Castle Golf Club makes it imperative that clubs give greater attention to general health and safety procedures, in particular the area of course hazards, and the insurance you have in place at your club.

"The court found the club's failure to warn was a significant failure and was of a greater magnitude than that of Mr Gordon."

The SGU said it was not apparent that the club's accident book has been readily available for the reporting of incidents of accidents caused by golfers.

Glasgow Life and South Lanarkshire Leisure & Culture who operate municpal courses both confirmed they are reviewing safety measures.

Glasgow Life said it was examining its guidance to players in the light of the judgment although it said its six municipal public courses were designed to minimise risk.

A spokeswoman for South Lanarkshire Council said a review is being undertaken "of our on-course risk assessments incorporating directional and safety signage".

Edinburgh Leisure said that after the court case it introduced compulsory golfers' insurance which covers individuals who play on their municipal courses.

David Moir, secretary of Cathkin Braes Golf Club, said it had carried out a risk assessment and new warning notices were now in preparation, although he did point out that "the wee white ball is easily hit poorly and travels in a direction which it is not intended on many occasions".

He said the signs "will help 'advise' members and guests of dangers from, for example, adjoining fairways".

He added: "There are already some signs on the course but these need to be improved.

"The more warning signs the better the chance of all members and guests and walkers on the course will be aware of the need for vigilance."

The SGU pointed out that Niddry Castle had encouraged visitors to play on the golf course, whether or not they were experienced golfers.

"It was not entitled to assume that the people walking on the course were aware of the rules of golf or how to respond to a warning shout," it said.

"It ought to have been aware that some golfers would be beginners or relatively inexperienced and it was not entitled to assume that all golfers would play in a safe manner all of the time."

The SGU added: "Golf clubs and responsible officials need to understand that the general duty of care to members, visitors and employees has not altered, however this judgment places an onerous responsibility on clubs to ensure that the appropriate risk assessments are completed and that members and visitors are fully aware of the rules of golf."

Kate Bennett of HBM Sayers Solicitors, representing Mr Gordon, expressed her client's relief following the appeal court's decision but said her client remained disappointed that there was no finding of negligence on the part of Mr Phee for his failure to respond to warning shouts.

She welcomed the Scottish Golf Union's decision to recommend golf clubs give greater attention to general health and safety procedures and insurance arrangements, adding that individual golfers are also encouraged to carry specialist golfers' insurance.

Taiwanese devices have an update to the latest software waiting

Big news for HTC Butterfly owners this morning, as Engadget brings news that the Taiwanese version of the device is receiving an update to Android 4.2.2 and HTC Sense 5. That brings the Butterfly in line with the HTC One, which shipped with Sense 5 and started to see its own Android 4.2 update in recent days. It's a big update for the Butterfly, which has been on the older Sense 4+ since it launched late last year. While Engadget reports that not all of the HTC One's user experience has made it across, the core software — including the BlinkFeed home screen reader — is in place.

Butterfly owners in Taiwan can expect an small, initial update to prep the phone, followed by a larger OTA containing the new firmware. No word yet on when the latest update will be hitting the U.S. version of the Butterfly, Verizon's Droid DNA — fingers crossed for a speedy turnaround on that one.

iOS 7 preview: Lock screen

iOS 7 brings not only live, physics-based wallpaper to the iPhone and iPad Lock screen, but Notification Center and Control Center access as well!

The Lock screen exists in some between-space, where your iPhone, iPod touch, or iPad are no longer off or asleep, but nor are they fully awake and functional yet. With iOS 7, however, Apple has greatly increased the Lock screen's functionality, mainly by giving it access to Notification Center and the new Control Center, while retaining its own notifications and fast Camera access.

Apple doesn't have a dedicated description for the new Lock screen features, but they do mention them in the context of other features. From Control Center:

Just swipe up from any screen ? including the Lock screen ? to do things like switch to Airplane mode, turn Wi-Fi on or off, or adjust the brightness of your display.

From Notification Center:

You can access Notification Center from any screen, including the Lock screen. Just swipe down. And get up to speed.

From Find my iPhone:

Even after a remote erase, Find My iPhone can continue to display a message with your phone number on the Lock screen.

And here's what Apple's shown so far:

  • There's at least one, new, live wallpaper. It appears to have depth, or at least varied levels of blur, and, as Apple terms it, "vitality".

  • Up and down chevron icons give a visual indication of where Notification Center and Control Center live, and just like elsewhere in iOS, they can be accessed via a downward or upward swipe from the bezel, respectively.

Control Center on Lock screen

  • Notification Center on the Lock screen, of course, includes the new, tabbed, Today, All, and Missed views.

  • Passcode has been redesigned and, thanks to its blur and translucency effect, it takes on the flavor of the wallpaper below.

  • The time and date are still front and center on the Lock screen, though they've been giving the Helvetica Neue Ultra-Thin treatment, like much of the rest of iOS 7.

  • Slide to Unlock, the now iconic control for accessing an iPhone, iPod, or iPad, is still there, and in the same place, but its interface chrome - its button and slider channel - has been removed leaving only the text itself. It still has a sweeping, highlight animation to help draw attention to it, though it appears now to be slanted on the diagonal.

  • Fast Camera access is also still there, also redone in the new iOS 7 aesthetic.

  • Lock screen notifications, unsurprisingly, also remain on the Lock screen.

"Live wallpapers" aren't new, but they've previously been animated, like old-fashioned keyframe cartoons, or like video recordings. What Apple appears to be doing is actual, real live wallpapers, using the same physics engine that's driving their new UIKit dynamics and Sprite Kit. These wallpapers move just like other iOS 7 elements, in relation to how the device itself is moved (almost certainly programmatically in reaction to the accelerometer and gyroscope). Yes, even the wallpapers are objectified and gamefied.

We've only seen the circles so far, but hopefully come the fall there'll be a wider variety of choices and perhaps, one day, a way for us to make, or at least buy or download, custom ones.

The up and down chevrons, while aiding in discoverability for Notification Center and Control Center, also create some confusion, especially the latter due to its proximity to the Slide to Unlock control. It could make a casual observer think they should slide up to unlock, instead of the proper left-to-right.

Fast Camera access also shares the same direct manipulation gesture as Control Center, simply offset to the right. Again, the Camera glyph makes it discoverable, but the doubling up of the gesture could again be confusing.

Passcode has a great, flat white effect when entering numbers. It might not look like much, but on top of a translucent blur, it's as impressive as it is ingenious.

Slide to Unlock experiences almost the opposite problem. With the interface elements reduced to pure text, it's lets discoverable and more confusing than ever. However, it looks like you can swipe left-to-right from almost anywhere on the screen to trigger it, making it more usable once discovered. (Swiping right-to-left doesn't seem to be used for anything right now, or at least nothing Apple's shown off to date.) On the positive side, the highlight, which is designed to draw attention, looks like its now diagonal, which is clever.

Lock screen notifications, makeover aside, seem to be functionally consistent with previous versions of iOS. Because Notification Center now works from the Lock Screen, some of their functionality may seem to have been superseded. They remain an at-a-glance list of recent alerts, however, which is faster if less in-depth than what Notification Center offers.

Apple hasn't shown if double clicking Home still brings up media controls in iOS 7, the way it has for previous versions of iOS. However, Control Center now includes media controls, so they may not be necessary any more.

All these new features do come with a downside, however. The more functionality you make available outside the Passcode system, the more information can be accessed without needing the Passcode. That now includes anything and everything in Notification Center.

Also, because Passcode has to allow access to this data, and to functions like emergency calls, it remains a vulnerability in an otherwise secure chain, and just as we've seen numerous times in the past, vulnerabilities can and will be exploited.

If past behavior is any indication, however, Apple will let us turn off Lock screen access to Notification Center and Control Center, just like they've let us tun off Lock screen access to Siri, Passbook, and other features in the past.

That’s the conclusion of a study by faberNovel, a Paris-based consulting group that has published the results of its work with a detailed 127-slide report titled: LinkedIn, The Serious Network. FaberNovel has a history of doing reports about the tech giants. As Ingrid Lunden wrote, last year it examined?why Facebook at that time was the perfect startup. And in years past, the firm has published reports about?how Amazon controls e-commerce,?how Apple dominates, and?what could go wrong with Google. The company chose Linkedin for its expertise in data analytics and algorithms, which has helped LinkedIn become far more than a site to post a resume. Instead, FaberNovel argues, LinkedIn is positioned to become a mega business platform. Since its start 10 years ago, LinkedIn has become the place for people to network. In recent years, though, it has started pooling the data, becoming one of the early adopters of open-source data technologies, such as Hadoop and Lucene/Solr for search. It has one of the most-recognized teams of data scientists who have learned to shape the data to create what CEO Jeff Weiner calls a global economic graph. It’s through the understanding of its users’ interactions that LinekdIn is establishing a platform that could put it in a position to emerge as an enterprise services provider and a player in the CRM market. LinkedIn understands the new concepts of business, particularly the transition from hierarchical to network-based organizations. The trend is to treat business as a graph more than a top-down organization with centralized communications and infrastructure. The company is adapting to this change in how an organization functions by focusing on talent as the center of its network. This provides the basis for developing products and services that span recruitment, as well as the expansion into the CRM and media markets. FaberNovel argues that the data LinkedIn collects and efficiently analyzes will help the company realize what LinkedIn CEO Jeff Weiner calls the company’s dream to create an economic graph that identifies the connections in its vast talent network. YouTube Confirms Renewed VEVO Deal, Takes Stake In Company

Not only does the deal allow YouTube to keep VEVO's videos on its site, but it also requires Google to invest in VEVO. Though terms of the deal have not been disclosed, Billboard estimated in February that it is worth between $40 million to $50 million and would give Google a 7 percent stake in VEVO.

Cyclists who want ANT+ sensors frequently have to either buy multiple devices or resign themselves to relatively limited tracking. Not so with Factor Bikes' new Vis Vires. The high-end road bike comes with a specially mounted Garmin Edge 510 or 810 bike computer, giving it speed and other basic ride data from the start; more advanced models bring ANT+ aware cranks that register leg power at the pedals. It's no secret that HP has struggled when it comes to tablets.
